Description

 

A Dutch SME, Tulp Elektronica, developed a unique music player that could simultaneously display the dance moves to enable the listener to practice dancing. Apart from Europe and North America which were the main target markets for the product, they decided to enter potential Asian markets including India. They therefore filed for and obtained patent protection for the technical solution behind the product in all these target countries. The music player did particularly well in India, especially among big hotels and event venues where substantial gatherings participated in dancing. They decided to reach a larger audience, notably households. But soon they realized that their patent was possibly being infringed by two local companies who were selling similar music players under different brand names for this particular clientele, thereby encroaching on their potential profits. Further investigation demonstrated that they are facing a case of infringement of their patent in India. Tulp Elektronica’s management, therefore, decided to contact an Indian IP expert to determine how to act in the given situation
