A Plant Variety Right is supposed to grant protection to the breeder.
How does this protection work in practice? How does it work when others do not seem to mind that a variety is a protected variety, or do not understand what that means, and the right is infringed? What actions are available to the right holder to prevent or stop infringements of his right?
The purpose of this webinar is to walk you through European enforcement regimes, a variety of legal actions like injunctions and conservatory or provisional measures, compensation of damages and connected claims, with the objective that the participants gain a good degree of practical knowledge concerning the remedies available to right holders and the way how enforcement actions are being dealt with by the courts in the EU.

Increasingly, plant breeders and PBR title-holders are facing illegal propagation of their registered varieties in different countries. While the law enforcement is familiar with other IP rights, such as Trademarks, the enforcement activities in PBR may be more challenging due to specific character of the rights' subject - a perishable living plant - and the botanical expertise required for the variety identification. The participants will be introduced to the basics of PBR enforcement, including preconditions, procedures, and documentation. Case examples will be given to illustrate the available enforcement tools.
