WIPO Strategy on Standard Essential Patents 2024-2026

Standard essential patents (SEPs) are a specific type of patents that protect the technology incorporated in a standard. They are essential in that the implementation of the standard requires the use of the inventions covered by the relevant SEPs. 

World Intellectual Property Organization (WIPO) has recently published a strategy document that sets out a three-year strategic plan for WIPO in the field of SEPs. The strategy, grounded in the guiding principles of neutrality, complementarity, and voluntary participation, outlines WIPO's ongoing initiatives and delineates the four key pillars of its future endeavours. These pillars aim to position WIPO as a global forum for dialogue, enhance transparency, serve as a repository of knowledge and data, and deliver impactful services in the realm of SEPs.

WIPO plays a crucial role at the international level in addressing global issues related to SEPs and FRAND (Fair, Reasonable, and Non-Discriminatory) licensing. The global distribution of products incorporating standardized ICT technology highlights the necessity for initiatives that transcend national or regional boundaries. Without aiming to replace or correct market mechanisms or domestic policies, the International Bureau of WIPO is considering a series of activities designed to foster dialogue, enhance transparency, and assist parties in finding amicable solutions in their SEP licensing negotiations.
