Uruguay opens its doors to a broader spectrum of trade marks in response to the changing landscape of technology and digitalisation. From 1st March 2024, four non-traditional trade mark categories will be introduced in line with Resolution 18/2023 of the National Directorate of Industrial Property (DNPI).
Applicants will soon be able to register the following types of trade marks:
- Pattern trade marks, consisting exclusively of regularly repeated elements.
- Movement trade marks, which involves movement or changes in the position of the elements.
- Position trade marks, characterised by the specific way in which the mark is placed on or affixed to the product.
- Multimedia trade marks, which are a combination of image and sound, and may include words, figurative elements, labels, etc., alongside the image and sound.
Until March, the following non-traditional TMs can be registered in Uruguay: 3D/shape, colour position/combination, and sound marks. Soon 4 more categories will be registrable too.
It is important to note that in Uruguay, these trade marks will be protected under Trade mark Law No. 17011.
