Patentability of Medical Use Inventions and Future Outlook

The patentability of medical use inventions is a controversial matter not only in Vietnam but in most jurisdictions. As in some other countries, Vietnam currently excludes the patentability of new uses of known substances. In this article, we present the current landscape of patentability of medical use inventions in Vietnam from both a theoretical and practical lens. In particular, we will focus on the enforceability of such patents and what the future holds for such inventions.
