Out Now: New Case Study on Protection of Well-Known Trade Marks in India

The India IP SME Helpdesk team has just released a brand-new case study spotlighting the importance of protecting well-known trade marks in India.

Tracing the story of the Austrian small and medium-sized company "TrainShoes", the case study sheds light on how the company successfully established its brand in the Indian market, but was soon confronted with an IP conflict as an Indian company was manufacturing shoes and clothes under the same brand. 

Not only had the infringer started to commercialise products under its brand, but it had also registered it as a trade mark at the Trade Mark Registry. TrainShoes had not monitored the Journal of the Indian Trade Mark Registry and therefore had not noticed that the third party had succeeded in registering a mark identical to its own and hence had not filed an opposition to its registration.
