MakeMyTrip Takes Legal Action, Approaches Supreme Court Regarding Google Ads Program

Suspension of trademark procedures finally possible in China

In an appeal filed before the Supreme Court, MakeMyTrip, a prominent online travel operator, alleged that the Google Ads program infringed on its trademark rights. The company contends that Booking.com, a competitor, has been able to purchase the 'MakeMyTrip' keyword through Google Ads, resulting in sponsored links to Booking.com appearing in Google search results for the keyword.

The case, scheduled to be heard by a Supreme Court panel led by Chief Justice of India DY Chandrachud, brings attention to the intricate legal matters surrounding trademark usage in online advertising. MakeMyTrip argues that its exclusive rights to its trademark have not been sufficiently safeguarded and seeks a ruling to prevent competitors from utilizing its trademark in sponsored links.

This legal dispute involving MakeMyTrip, Google, and Booking.com holds considerable significance for the online travel sector and the interpretation of trademark laws in the digital era.
