INPI Argentina requires reporting on the priority status of patents
The National Institute of Industrial Property (INPI) of Argentina has issued Resolution 364/2024, which imposes strict penalties on patent applicants who have claimed priority. According to the new regulation, applicants have 60 days to notify whether priority has been granted in the country of origin, with no automatic extension. Failure to reply within the time limit will result in the forfeiture of the application.
Argentina removes copyright fees for private spaces:
In June, President Javier Milei signed Decree 765/2024, which removes copyright royalties for the reproduction of songs, films and other works in private spaces in Argentina. The new regulation redefines 'public performance' to apply only to publicly accessible spaces, thus excluding places such as hotels and private rooms. This change contrasts with European practices, such as STS 428/2007 of 16 April 2007, which considers such broadcasts in hotels to be public performances and require prior authorisation from rights holders. The European approach shows a stricter stance on the application of copyright in private commercial spaces.
