On 31 August, the Permanent Committee for the Improvement of Procedures and Examination Guidelines for Trademarks, Industrial Designs, and Geographical Indications (CPAPD) published a Technical Note aiming to improve internal processes while respecting current legal norms and societal expectations.
The CPAPD recognized that "cachaça" is also a typical denomination of the traditional Brazilian beverage born in sugar mills in past centuries. Additionally, "Cachaça" is a product identified with official standards of identity and specific qualities.
Therefore, it has been established that the term "cachaça" can have different meanings - sometimes as a geographical indication and sometimes as the name of a beverage - depending on the context in which it is applied.
As a result, the requirements outlined in that Technical Note will no longer be applied in new registration or modification requests, as well as ongoing registration or modification requests.
