
The Cinematograph (Amendment) Bill 2023, intended to replace the Cinematograph Act of 1952, has cleared both houses of parliament and is awaiting formal notification. The bill seeks to modernize regulations governing film certification, exhibition, and censorship in India, addressing issues like digital piracy and copyright infringement in the online domain, which have affected the film industry.
Sections 6AA and 6AB of the bill aim to combat digital piracy by prohibiting the use of audio-visual recording devices in licensed film venues with the intention to infringe copyright over the film being shown. The bill further grants authority to the government of India to hold intermediaries accountable for their involvement in the facilitation of digital piracy on online platforms where films are hosted or distributed. Additionally, the bill mandates the appointment of nodal officers to manage takedown requests and ensure compliance by digital platforms.
