Colombia updates rules for claiming color in trade marks

Decision 122 of 2025 modifies the rules for claiming colour in trade marks in Colombia, simplifying the requirements and reducing the procedures before the Superintendence of Industry and Commerce. 

From 7 January 2025, trade mark applications must comply with more precise requirements: if color is claimed, all colors present in the trade mark must be explicitly specified, avoiding ambiguous terms such as "dark" or "light". 

In addition, if no colour is claimed, the mark must be filed in black and white. Likewise, if the background is white and not claimed, it will be understood that it is not protected. 

Lastly, the exact code should be provided if an internationally recognized color identification system (such as Pantone or RGB) is used.
