1. Background:
Indonesia, with a population of over 270 million, is the most populous country and has the largest economy in ASEAN. It should therefore be a key market for European businesses. When deciding to enter a new market, every entity should consider the protection and enforcement of Intellectual Property (IP) amongst the top priorities.
As of today, all types of IP rights are regulated by Indonesian laws. In order to protect innovative products and processes, Indonesia offers protection of patents and utility models (also called simple patents). To simplify the access to patent protection for SMEs, Indonesia ratified the Patent Cooperation Treaty at an early stage for ASEAN Member States (in 1997), therefore enabling applicants to benefit from the international patent system administered by the World Intellectual Property Office (WIPO).
In 2022, WIPO recorded that most applications were filed in Asia; however, Indonesia was not listed as the highest contributor to patent applications. Rather, the figures were quite low compared to other ASEAN countries (in 2022 alone, only 9 applications were filed). According to local IP experts, one of the causes behind this issue may be the complexity and weakness of patent enforcement as of today in Indonesia. Therefore, to attract more innovation and investment within the Republic, a stronger law enforcement ecosystem is deemed necessary.
As a result, EuroCham Indonesia in collaboration with the South-East Asia (SEA) IP SME Helpdesk (an initiative of the European Commission), is organizing an event titled “Indonesia: Becoming a Leader in ASEAN Patent Legal Jurisprudence and Boosting Business through a More Robust Enforcement”. This event aims to provide an avenue for European businesses, including SMEs, to gain insights, awareness and certainty from local IP experts on the current trends in patent law enforcement.
This event is also expected to be a platform for industry players to have a dialogue and help to develop Indonesia as the preferred forum for patent litigation in South-East Asia. Indonesia's judiciary plays an important role in the current political stability and there are also promising prospects for the judges to develop Indonesian IP jurisprudence, especially in patent enforcement.
