2021 has witnessed tremendous changes in China’ digital landscape – more than ever, intellectual property (IP) protection in digital economy plays a crucial role in ensuring successful business operation in China. What can European companies do to protect their IP, when Covid pandemic continues to keep business as well as infringers online, and at a time when China promogulated Data Security Law and Personal Information Protection Law?

European Union Chamber of Commerce in China (EUCCC) Shanghai Chapter and China IP SME Helpdesk organise the joint Working Group Meeting ‘IP Protection in China’s Evolving Digital Economy: E-commerce, Data localisation, and more’ to provide SMEs and MNCs the tools for designing a comprehensive IP protection strategy for digital economy.

At this meeting, Mr. Matias Zubimendi, IP Business Advisor at China IP SME Helpdesk will give an overview of IP in China’s digital economy and discuss IP protection and management on e-commerce platforms as well as the role of new digital technologies in IP enforcement and protection. Ms. Jin Ling, Head of IP Commercial & Digital Services at Beijing Lusheng Law Firm, will discuss IP risks in data localisation and ways of mitigating them. Following the two presentations will be a Q&A session led by Mr. Felix Engelhardt, Vice-chair of the European Chamber IPR Working Group.

Ling is a PRC licensed lawyer at Lusheng Law Firm, a member of the Rouse Network. With her unique combination of 10 years of experience as a legislator at the Chinese State Council, Ling has over 19 years of experience in commercial laws, regulatory advice, M&A, technology transfer, IP commercial and IP litigation, Media, Advertising, and Digital law.

International companies often call upon Ling for China regulatory and market access advice, especially in the fields of education, publishing, technology, and media. She is known for her well-rounded knowledge in the full scope of advisory, regulatory, transactional and litigation matters concerning Intellectual Property Rights (IPR) throughout the course of doing business in China, including general corporate and commercial matters, technology transfers, R&D cooperation agreements, IP management strategies, due diligence and audits, and high profile litigation cases defending brand owners’ IPR encompassing copyright, patent, and trade mark. Drawing on her extensive commercial and IP experience, Ling spearheaded our firm’s marketing, advertising and digital commerce practice where she regularly assists international companies in drafting and reviewing marketing, distribution and service agreements, manage compliance and IP risks for clients in areas including advertisement proposal, branding, promotion, packaging and labeling, and internet marketing.

Mr. Matias Zubimendi is the IP Business Advisor at China IP SME Helpdesk in Beijing, where he advises European SMEs on intellectual property rights matters. Mr. Zubimendi holds a Master’s degree in Chinese Civil and Commercial Law from Peking University as well as a Master’s degree in Intellectual Property Law from Austral University in cooperation with the World Intellectual Property Organisation. Mr. Zubimendi has a strong background in both business development and intellectual property rights protection, having previously worked as a China Business and Legal Consultant at Terragene, where he focused on business development and as a Director of Legal Affairs at Conquer Europe. Previously, he has also worked as a Patent and Trademark Attorney at Phoebus Abogados and Mazzeo & Canet, where he represented SMEs as well as Fortune 500 companies.

Mr. Zubimendi has given lectures at various conferences including the Ibero-American Conference on Chinese Studies and published several articles including “The legal protection of intangibles in the video games industry”. As a Professor Assistant, he has also given lectures on Commercial Law and Procedural law, while focusing on Copyright and AI in his research. Mr. Zubimendi is a native Spanish speaker fluent in English.
