
The Supreme Court of India has invited the public and stakeholders to provide feedback on its draft Regulations for the Use of AI in the Court (2026), which are intended to establish a governance framework for the use of artificial intelligence in the judicial system.
The proposed regulations are based on the following key principles: human oversight; transparency; accountability; cybersecurity and data protection; integrity; and judicial independence.
According to the draft regulations, AI may only serve an assistive role in court processes and cannot replace judicial decision-making or human authority. The rules explicitly prohibit judicial decisions being made solely through algorithmic processes or AI-generated outputs.
AI is not a get-out-of-jail-free card for judges and court officials. They are still entirely accountable for their decisions and cannot use AI errors, system opacity (so-called "black box" issues), or hallucinations as a defense against accountability.
Stakeholders can submit their comments to the court’s AI committee via email until 20 June 2026.
