The European IP Helpdesk has published an updated edition of Your Guide to IP Management in International Business. This revised version builds on the guide originally developed and published in October 2019

Expanding into foreign markets can open important opportunities for businesses, including access to new customers, diversification, talent pools, competitive advantage and foreign investment. However, before venturing abroad, it is vital to protect the intellectual property (IP) assets — such as patents, know-how, trademarks or designs — that are at the core of your company. 

The guide outlines the essential IP steps to consider when internationalising your business. It explains how to draft an IP inventory and conduct IP due diligence and audits, and introduces IP valuation as a tool to support negotiations and commercial decision-making. It also provides guidance on establishing an appropriate IP strategy, including the role of Freedom-to-Operate analyses, particularly in technology-intensive sectors. 

It also addresses practical aspects such as identifying business partners, using confidentiality agreements, understanding local IP rules and differences across jurisdictions, and making use of international mechanisms including the Madrid System, the Hague System, the Patent Cooperation Treaty (PCT) and the Berne Convention. 

In addition, the publication explores business models such as joint ventures, licensing and franchising, and outlines available enforcement measures — from cease and desist letters to civil, criminal and alternative dispute resolution procedures.
