INPI Simplifies the Registration of Technology Transfer Agreements

This resolution eliminates formal verification of the submitted documentation, transferring full responsibility to the applicant. Now, through a sworn statement, the parties affirm the authenticity of the documentation, streamlining the process by avoiding delays due to INPI validation.

Furthermore, the agreements are simplified, as they can be made directly between the licensor and licensee without requiring prior INPI approval.

Technology transfer agreements: These consist of licensing agreements whereby a company is authorized to produce or market products using certain intellectual property rights. The licensor, the holder of these rights, oversees their use and guarantees the quality of the products. The licensee, in turn, receives authorization to manufacture or sell said products for mutual benefit. For the management of intellectual property rights, the licensee pays the licensor an initial fee and periodic payments (royalties), thus compensating the holder for the use of their rights.

Argentina's National Institute of Industrial Property (INPI) Streamlines Trade mark Registration with Mandatory Electronic Notifications

The trade mark registration process has been expedited through the implementation of mandatory electronic notifications, eliminating the 30-day period that previously allowed third parties to review new applications and file oppositions. This significantly accelerates registration.

The digitization of the verification of the application allows all notifications to be managed electronically. Applicants are responsible for the accuracy of all information and documents provided, under oath, thus facilitating a more efficient process.
