IP Treaties reinstated in Venezuela

The Venezuelan Autonomous Service of Intellectual Property (SAPI) recently announced the direct application in Venezuela of all the legal standards from the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS Agreement). 

Likewise, this direct application enables the Paris Convention for the protection of IP and the Nice Agreement (Concerning the International Classification of Goods and Services for the Purposes of the Registration of Marks) in Venezuela. 

As WTR already anticipates, this means that the following is applicable in Venezuela:

  1. The six-month grace period for trademark renewals
  2. The Nice Classification of goods and services
  3. Patent inventions whose claims refer to pharmaceutical species, food, and beverages.
