
On December 11, 2025, Argentina’s Instituto Nacional de la Propiedad Industrial (INPI) approved Resolution 583/2025, modernizing how trade mark applications are examined to make the process simpler, faster, and more predictable for entrepreneurs, professionals, and companies.
Key changes:
- Simplified scope of review: The INPI will now limit its initial examination of new trade mark applications to absolute grounds of unregistrability (e.g. lack of distinctiveness) and issues tied to public order. Objections based on relative grounds—like similarity with existing marks or private disputes—will only be considered if a third party files an opposition.
- Earlier review timing: Both formal and registrability checks will be done immediately after filing and before publication, rather than after.
- Faster grant process: If no issues are found, the application will be published for one day in the Trademark Bulletin, and if there are no oppositions within 30 days, the registration will be granted automatically.
- Phased implementation: The new criteria limiting the scope of examination are already in force, while the full procedural changes start on March 1, 2026, applying also to pending applications.
