
On 22 April 2025, the EU appealed the WTO panel report regarding Case DS611. The case involves a dispute between the WTO and China on the Enforcement of Intellectual Property Rights, specifically involving standard essential patents.
The WTO partially upheld the EU’s input, finding that China limits IPR through coordinated policies and must improve transparency by sharing IP-related information and court judgments with WTO members. Opposing another one of the EU’s claims, the WTO ruled that the Trade-Related Aspects of Intellectual Property Rights (TRIPS) Agreement does not obligate China to avoid measures that might hinder other WTO members’ implementation of the agreement within their own jurisdictions.
