
The Delhi High Court has ordered the removal of the trademark “BLUE SPOT” from the Register of Trade Marks after determining that the registered proprietor, Stardford Spirits Pvt. Ltd., had not demonstrated any bona fide commercial use of the mark for more than five years.
Justice Manmeet Pritam Singh Arora held that the allegations of non-use were effectively admitted, as the proprietor failed to appear or participate in the proceedings. This decision clears the way for Irish Distillers International Limited, part of the Pernod Ricard group, to safeguard its long-established family of SPOT whisky marks.
