Chile advances bill for non-waivable digital royalties

In November 2025, the Chilean Chamber of Deputies approved the 'Tommy Rey Law' bill, which strengthens artists' remuneration rights for the digital availability of their performances in phonograms and audiovisual works. The bill, which is now before the Senate, builds on Law No. 17,336 (related rights) and addresses a widespread contractual practice whereby performers broadly assign their rights to producers or labels, resulting in them receiving no real share of revenues generated by digital platforms.

The bill establishes that even if a performer has transferred the right of 'making available' to the producer, this does not affect their right to receive equitable remuneration each time their performance is offered online. This payment must be made by the party responsible for making the performance available and is managed exclusively through collective management organisations. The amount is set out in Article 100 of Law 17,336. In essence, the measure does not create a new exclusive right, but rather safeguards performers' remuneration against broad contractual assignments in the digital environment.
