Brazilian Courts have jurisdiction on infringements through ISPs

Recently, the Brazilian Third Chamber of the Superior Court of Justice (“STJ”) has ruled that Brazilian Courts have jurisdiction in cases involving infringements that have been committed through internet services, even in those cases where the Internet Service Provider (ISP) is hosted on servers located abroad.

In accordance to the STJ, Brazilian Courts are competent no matter where the host is domiciled, since the act of infringement was performed in Brazil, where the plaintiff is based.
