Argentina's National Institute of Industrial Property (INPI) has adopted a new regulation governing the recording of ownership transfers and changes in business activity related to intellectual property rights. The new framework aims to modernise and simplify administrative procedures while improving legal certainty for applicants.
Among the key changes are the introduction of a sworn declaration principle for all submitted documentation, the removal of apostille and consular legalisation requirements for documents issued abroad, and the possibility for either the transferor or the transferee to request the registration of a transfer. The regulation also clarifies that ownership transfers and changes in business activity take effect from the date the application is filed.
The new rules further establish procedures for specific situations, including successive transfers, trusts, and asset divisions resulting from divorce or inheritance, while providing applicants with extended opportunities to address deficiencies before an application is rejected.
The regulation also confirms the use of the online application form available through the INPI Web Portal as the official submission channel.
