Andean Court Clarifies Rules on Early Copyright Protection Measures

The Court of Justice of the Andean Community has issued a new ruling clarifying how precautionary measures can be used in copyright cases. The decision focuses on whether such measures can be applied before a formal legal or administrative case is started.

The Court confirmed that, under Decision 351—the common copyright framework for Andean countries—these measures can indeed be taken in advance, as long as national law allows it and basic legal safeguards are respected. This means authorities may act early to prevent potential copyright infringements.

The ruling also emphasises that Andean Community law must be applied consistently across all member countries. National laws cannot contradict these common rules, and if they do, they must be adjusted.
