Industrial Design Infringement (Fibre Optic Cables)

The SME produces and sells fibre optic cables. They use Chinese suppliers that produce some of their products in China while the products are not sold on the China market. During a trade fair in the UK, the SME saw several Chinese competitors selling highly similar products. The design and colour of the Chinese products were exactly the same as the SME’s, but the Chinese products did not bear the trademark of the SME. The SME has obtained patent protection and industrial design protection in their home country (a national design instead of an EU
industrial design), but not in China.
